TERMS & CONDITIONS

By confirming a booking and making payment of the required deposit, the client acknowledges that they have read, understood, and agreed to the following Terms & Conditions.


1. Booking Confirmation

A booking is only confirmed once a non-refundable deposit of 25% has been paid.

  • A 25% deposit is required to secure the proposal date.
  • The remaining balance must be paid no later than 7 days prior to the proposal date, unless otherwise agreed in writing.
  • Bookings made within 7 days of the proposal date require full payment upfront.
  • Failure to make final payment by the due date may result in cancellation of the booking without refund of the deposit.

2. Deposits & Refund Policy

Due to the planning, preparation, and resources required to design and coordinate proposals:

  • All payments are strictly non-refundable.

3. Design & Styling Expectations

The Proposal Planners provides custom proposal styling based on the agreed concept.

  • Inspiration images provided by clients are used as reference only.
  • Exact replication of images from Pinterest, social media, or other vendors cannot be guaranteed.
  • Styling elements may vary depending on inventory availability, florals, weather conditions, lighting, location restrictions, and environmental factors.

By confirming the booking, the client agrees to trust the creative direction and styling expertise of The Proposal Planners.

Differences between inspiration images and the final setup do not constitute grounds for refunds or disputes.


4. Creative Control

The Proposal Planners retains full creative control over the final design execution.

Minor adjustments may be made on the day due to:

  • Weather conditions
  • Wind or environmental factors
  • Location restrictions
  • Safety considerations
  • Lighting conditions
  • Space limitations

These adjustments are made to ensure the best possible outcome for the proposal setup.


5. Styling Satisfaction & Subjective Preferences

Proposal styling is a creative service, and aesthetic preferences are inherently subjective.

By confirming a booking, the client acknowledges that:

  • Styling outcomes may vary from inspiration images.
  • Final designs are based on the agreed concept and available materials.
  • Personal opinions regarding styling, colour tones, décor placement, or creative interpretation do not constitute grounds for refunds, discounts, or disputes.

6. Design Changes

To ensure smooth planning:

  • All design details must be finalised at least 7 days prior to the proposal date.
  • Requests for major changes after this time may not be accommodated.
  • Additional styling requests may incur additional fees.

7. Weather & Outdoor Proposals

Outdoor proposals are subject to weather conditions.

The Proposal Planners reserves the right to:

  • Modify the setup
  • Adjust styling elements
  • Relocate the setup within the same area
  • Suggest a backup option where possible

No refunds will be issued due to weather conditions. Rescheduling may be offered where possible but cannot be guaranteed.


8. Location Permissions

The client is responsible for ensuring the chosen location permits proposal setups. This includes:

  • Obtaining permission for private venues
  • Ensuring compliance with council regulations
  • Securing permits where required

The Proposal Planners is not responsible for disruptions caused by venue management, security, or council authorities where permissions have not been obtained.


9. Proposal Secrecy & Coordination

Proposal setups rely heavily on timing and discretion.

Clients must follow all instructions provided by The Proposal Planners including:

  • Arrival time
  • Communication instructions
  • Location entry guidance

If the surprise element is compromised due to circumstances outside of The Proposal Planners’ control, the company cannot be held responsible.


10. Early Arrival & Public Interference

For proposals held in public spaces:

  • Members of the public may be present near the setup.
  • Individuals may occasionally observe, photograph, or approach the setup.

The Proposal Planners cannot control public behaviour, crowds, or interruptions.

If the client or their partner arrives before the scheduled proposal time and sees the setup during installation, no refunds or discounts will apply.


11. Setup, Hire Period & Pack Down

Proposal setups are installed for a limited hire period.

Clients must not:

  • Move décor
  • Reposition props
  • Remove items
  • Adjust styling elements

Pack-down will occur at the scheduled time.


12. Damage, Theft & Responsibility

The client assumes responsibility for all hire items during the proposal period.

The client agrees to cover the cost of repair or replacement for items that are:

  • Damaged
  • Broken
  • Lost
  • Stolen

This includes décor, props, signage, furniture, florals, lighting, and styling structures.


13. Guests & Third Parties

If friends or family attend the proposal, the client is responsible for ensuring guests:

  • Respect the setup
  • Do not interfere with styling elements
  • Supervise children around décor and lighting

The Proposal Planners is not responsible for damages caused by guests.


14. Third-Party Vendors

Where third-party vendors are engaged (such as photographers or musicians), The Proposal Planners is not responsible for their performance, cancellations, or service delivery.


15. Photography & Marketing

The Proposal Planners may photograph or film proposal setups for:

  • Website
  • Social media
  • Promotional material

If a client requires their proposal to remain private, this must be requested in writing prior to the event.


16. Abandoned Proposals

If the client fails to attend the location at the agreed time and does not communicate with The Proposal Planners:

  • The setup will be packed down after the allocated hire period.
  • The booking will be considered completed.

No refunds will be issued.


17. Force Majeure

The Proposal Planners is not liable for circumstances beyond reasonable control including:

  • Extreme weather
  • Natural disasters
  • Government restrictions
  • Venue closures
  • Public safety concerns

Where possible, a reschedule may be offered.


18. Liability

The Proposal Planners will not be held liable for:

  • Personal injury during the proposal
  • Damage to personal belongings
  • Unforeseen disruptions at public locations

All décor is installed for styling purposes only and should not be leaned on, climbed on, or used for support.


19. Chargebacks & Payment Disputes

By making payment, the client acknowledges they are entering into a binding agreement with The Proposal Planners.

The client agrees not to initiate a chargeback, payment reversal, or payment dispute for services delivered in accordance with these Terms & Conditions.

If a chargeback is initiated, The Proposal Planners reserves the right to provide invoices, communications, and photographic evidence of services delivered to the payment provider.

Any chargebacks made in bad faith may result in recovery action for the outstanding balance, associated bank fees, and administrative costs.


20. Acceptance of Terms

By confirming a booking and paying the required deposit, the client acknowledges and agrees that they:

  • Have read and understood these Terms & Conditions
  • Accept all policies outlined above
  • Agree to proceed under these conditions
  • Understand that payment of the deposit forms a binding agreement for services with The Proposal Planners
